1. Scope and subject matter of the contract
1.1 These Terms apply to all products, services and digital content provided via the ecufile.eu platform.
1.2 By using the platform or purchasing a product you agree to be bound by these terms and conditions.
1.3 Deviating terms and conditions shall only apply if they have been confirmed in writing by ecufile.

2. Target group / authorization of use
2.1 The services offered are aimed exclusively at professional vehicle tuners with proven experience.
2.2 Use by private individuals, laypersons or unqualified third parties is prohibited.
2.3 By creating an account, you confirm that you are of legal age and authorized to use these services as part of your professional activity.

3. Prohibited uses
You undertake not to use the platform:

for illegal purposes or activities

to spread harmful software (e.g. viruses, Trojans, malware)

for the infringement of copyrights or trademarks

to resell or redistribute downloaded files without permission

for processing third-party files or third-party software (no support!)

A violation can lead to the immediate and permanent blocking of your access.

4. rights of use & licenses
4.1 With the purchase of credits, you receive a non-exclusive, non-transferable right to use the respective tuning files.
4.2 The creation of copies, the creation of archive databases or sharing with third parties is prohibited.
4.3 The use of remote maintenance software such as Anydesk, TeamViewer or similar for file distribution is expressly prohibited and will result in the license being blocked.

5. Files & support
5.1 We do not guarantee support if you submit edited files from other tuners or tools.
5.2 Support is only provided for original files.
5.3 We accept no liability for errors, damage or problems to the vehicle resulting from the use of our files.

6. return & refund
6.1 There is no right of return for digital products after download.
6.2 Refunds are excluded – even if the customer is not satisfied with the delivered solution.
6.3 Payments also apply to time spent, customisation or analysis – regardless of the result.

7 System manipulation & legal action
7.1 Any attack on our platform (e.g. data misuse, targeted error triggering, system scan, hacking attempts) will lead to a report in accordance with applicable law (UK & EU).
7.2 Technically verifiable licence violations will result in the permanent suspension of your licence and the initiation of legal action.

8. dongle & hardware
8.1 In case of loss or damage of the ecufile.eu dongle a replacement fee of 500 € net will be charged.
8.2 The dongle remains our property – any manipulation, duplication or resale is prohibited.

9. product range, changes & updates
9.1 We reserve the right to change our offer, prices, files, file formats or licence models at any time.
9.2 There is no entitlement to specific solutions, features or guaranteed content.
9.3 New functions or sample modules are added on an ongoing basis – however, we cannot guarantee complete availability.

10. disclaimer
10.1 ecufile is not liable for:

Damage due to incorrect application

Use in unsupported environment

Changes to files by third parties

incorrect or incomplete information provided by the customer

10.2 Any use of our files is at your own risk.

11 Jurisdiction and final provisions
11.1 The law of Luxembourg shall apply.
11.2 The place of jurisdiction is Luxembourg.
11.3 Should individual provisions be invalid, the remainder of the terms and conditions shall remain unaffected.
